By accessing or using MYXR ("the Platform"), creating an account, or confirming a booking, you agree to be bound by these Terms and Conditions. If you do not agree to these terms, please do not use the Platform.

2. Nature of Service

MYXR is a platform that connects users with recording studios, podcast studios, and rehearsal spaces ("Studios"). MYXR acts solely as an intermediary service provider facilitating connections between users and independent studio operators.

MYXR does not own, operate, manage, or control any of the Studios listed on the Platform. Each Studio is independently owned and operated by third-party providers who are solely responsible for their facilities, services, equipment, and personnel.

3. No Ownership of Studios or Content

MYXR does not claim ownership of:

• Any recording studio, podcast studio, or rehearsal space listed on the Platform
• Any music, audio recordings, video content, or other creative works produced by users at any Studio
• Any intellectual property created, recorded, or developed during booked sessions
• Any equipment, software, or resources provided by Studios

All rights to creative works produced during studio sessions remain with the respective creators, artists, and rights holders as determined by applicable law and any agreements between users and Studios.

4. Content Licensing and Publishing

MYXR is not liable for any content licensing, publishing, distribution, or royalty fees associated with:

• Music recordings, compositions, or performances
• Podcast episodes, audio content, or spoken word recordings
• Video productions, visual media, or multimedia content
• Samples, beats, instrumentals, or backing tracks used in sessions
• Cover songs, remixes, or derivative works

Users are solely responsible for obtaining all necessary licenses, clearances, permissions, and rights required for any content they create, use, sample, record, distribute, or publish. This includes, but is not limited to, mechanical licenses, synchronization licenses, performance rights, and sample clearances.

5. Booking Service Fee

A 12% service fee is applied to all bookings made through the Platform. This fee covers Platform maintenance, customer support, payment processing, and service operations. The service fee is non-refundable unless otherwise stated in our refund policy.

6. User Responsibilities

As a user of MYXR, you agree to:

• Provide accurate and complete information when creating an account or making bookings
• Comply with all Studio rules, policies, and guidelines
• Arrive on time for scheduled sessions and respect booking durations
• Treat Studio property and equipment with care
• Obtain all necessary rights and licenses for your creative projects
• Not engage in any illegal activities during studio sessions
• Respect the intellectual property rights of others

7. Limitation of Liability

To the maximum extent permitted by law, MYXR shall not be liable for:

• Any direct, indirect, incidental, consequential, or punitive damages arising from your use of Studios
• Quality, safety, or legality of Studio facilities or services
• Actions, omissions, or conduct of Studio operators or other users
• Loss, theft, or damage to personal property or equipment
• Copyright infringement, trademark violations, or intellectual property disputes
• Publishing, distribution, or licensing issues related to user-created content
• Technical issues, data loss, or recording failures at Studios
• Disputes between users and Studios regarding services rendered

8. Studio Relationships

Studios listed on MYXR are independent contractors and not employees, agents, or partners of MYXR. Any contract for services is directly between you and the Studio. MYXR does not guarantee the availability, quality, or suitability of any Studio for your particular needs.

9. Cancellation and Refunds

Cancellation policies may vary by Studio. Please review each Studio's specific cancellation policy before booking. MYXR's service fee may be non-refundable depending on the timing and circumstances of the cancellation. Refund requests will be evaluated on a case-by-case basis.

10. Indemnification

You agree to indemnify, defend, and hold harmless MYXR, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any third-party rights.

11. Privacy

Your use of the Platform is also governed by our Privacy Policy. By using MYXR, you consent to the collection, use, and sharing of your information as described in our Privacy Policy.

12. Modifications to Terms

MYXR reserves the right to modify these Terms and Conditions at any time. We will notify users of material changes through the Platform or via email. Continued use of the Platform after such modifications constitutes acceptance of the updated Terms.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms shall be resolved through binding arbitration or in the courts of competent jurisdiction.
